Disclaimers
All staff, facilitators and the representative involved in Elemental Ecstasis Retreat (hereinafter referred to as “AGENTS”) act only in capacity as AGENTS for the participant in all matters connected to retreat activities, workshops/classes, excursions, lodging and accommodations and as AGENTS hold themselves free of responsibility for any damage occasioned by any cause. AGENTS shall not be responsible for personal injury, death, accident, delay, loss, damage, irregularity or property damage as a result of force majeure or for any other losses or damages incurred by any person or retreat participants caused by any delay or change of itinerary or arising out of any act, including, but not limited to, any act of negligence, any person acting for or on behalf of AGENTS for transportation, accommodation or classes, and workshops or any other person or entity rendering any of these services or accommodations being offered in connection with this retreat. This agreement supersedes all previous oral or written communications, representations, or agreements between the parties. Participants assume the risk involved when participating in yoga, excursions, and any and all activities and/or pursuits voluntarily undertaken while participating in the retreat. Participants agree that any and all disputes between Participants and AGENTS shall be governed by California law. Participants agree to mediate any and all disputes prior to the institution of any litigation. In the event of any litigation between the Parties to this agreement involving their respective rights or obligations, such litigation shall take place in San Diego County, California and the prevailing party shall be entitled to recover reasonable attorney’s fees and court costs of litigation. With regards to the stay during a retreat, AGENTS will provide safe, careful instruction and safe premises, but ask that each participant take personal responsibility for their own self-care and (in the unlikely case) for any injuries incurred during the retreat. Modifications may be given to participants with specific needs. If participants are unsure of their physical ability due to previous injuries, they should seek the advice of a healthcare practitioner beforehand.
Consent to participate in yoga, healing sessions, and other physical activities
All retreat participants must acknowledge by registering to this retreat you are agreeing to this consent to participate in all group classes and workshops including yoga, breathwork, sound healing, and Reiki. You understand that the services provided by all practitioners are intended to provide relaxation and reduce stress.
You completely understand that the services provided during this retreat are in no way a substitute for traditional medical treatment or advice. You are fully aware that your Practitioner will not offer any diagnosis or recommend any Medical Treatment or Prescribed Medication.
You understand that you must continue to have regular medical check-ups as part of your overall personal health care plan, and you should contact your own certified and licensed medical physician/doctor/health care professional for any physical or psychological ailments or concerns that you may have in order to get proper medical advice.
You agree and understand that your participation during this retreat is voluntary and that at any time during this retreat you can choose to end your participation. You also understand that you may experience 'self-healing reactions' or the detox symptoms during the 48 hours following the classes or healing sessions.
You understand that any information exchanged during any session is educational in nature and is to be used at your own discretion. You also understand that any information imparted during these sessions is strictly confidential and will not be shared with anyone without your written permission.
Finally, you understand that by registering for this retreat, you are agreeing to this informed consent that you are assuming full responsibility for participating in this retreat and you hold harmless both your Practitioner and the facility where the services are provided.
Waiver for Media Release
This retreat will be filmed and photographed. By attending this retreat you grant permission to The Social Garden and it’s retreat facilitators to use your image (photographs and or videos) for use in media publication for promotional use. You hereby waive any right to inspect or approve the finished photographs or electronic matter that may be used in conjunction with them now or in the future, whether that use is known to you or unknown. You waive any right to royalties or other compensation arising from or related to the use of this image.
Non-Violence, Discrimination and Sexual Harassment Policy
We are strictly enforcing non-violence, non-violent communications, discriminations and sexual harassment policy towards all retreat participants, staffs and facilitators. If you are violating and subject to any misconduct, offense and suspected to be potentially harming others, we have the right to dismiss you from this retreat entirely without a refund nor held responsible for any damages, legal actions, accidents and injuries due to your violations.
